13.3.1. The Franchised Business shall, at all times, be under the direct supervision of Franchisee. The Designated Manager shall devote full time and best efforts to the management of the dayto-day operation of the Franchised Business, but not less than forty (40) hours per week, including 8:30 a.m. to 4:30 p.m. on at least three weekdays (Monday through Friday), excluding vacation, sick leave and similar absences. Franchisee shall keep Franchisor informed, in writing, at all times of the identity of its Designated Manager. Franchisee must not engage in any business or other activities that will conflict with its obligations under this Agreement.

What This Means (2024 FDD)
According to Aplus's 2024 Franchise Disclosure Document, the Designated Manager must be present at the Aplus store for a minimum number of hours each week. Specifically, the Designated Manager is required to devote full time and best efforts to the management of the day-to-day operation of the Franchised Business, but for no less than forty (40) hours per week. As part of those 40 hours, the Designated Manager must be present from 8:30 a.m. to 4:30 p.m. on at least three weekdays (Monday through Friday). These requirements exclude vacation, sick leave, and similar absences.
This requirement ensures that the Aplus store has consistent and dedicated management during key business hours. The franchisee must also keep Aplus informed, in writing, at all times of the identity of its Designated Manager.
This requirement does not dictate the entirety of the Designated Manager's schedule, but it does mandate a significant portion of their time be during core weekday hours. This ensures consistent oversight during peak operational times. The franchisee is responsible for ensuring the Designated Manager meets these requirements and for communicating any changes in the Designated Manager's identity to Aplus.
