What is the Aplus franchisee's responsibility regarding structural steel, foundations, masonry, and framework for the buildings, canopies, and kiosks?

According to Aplus's 2024 Franchise Disclosure Document, the franchisee has no responsibility for the repair or replacement of structural steel, foundations, masonry, and framework for the buildings, canopies, and kiosks. This responsibility is retained by Sunoco.

This means that Aplus franchisees are not responsible for the costs associated with maintaining the structural integrity of the physical buildings, canopies, and kiosks. This could potentially save franchisees a significant amount of money over the course of the franchise agreement, as structural repairs can be very expensive.

However, the franchisee is responsible for maintaining the property in good order and condition at all times and for repairs necessitated by damages caused by the franchisee's employees, customers, invitees, vandals, or any other parties. Franchisees are also required to maintain a Preventive Maintenance contract with either Sunoco or a reputable contractor. If the franchisee chooses an independent contractor for PM, the franchisee must provide a copy of the PM contract to Sunoco's Maintenance Department each year during the Term of this Lease.
