Following termination or expiration of this Agreement the Franchisee will no longer use any of the Information, except to comply with the Franchisee's post-term obligations under this Agreement and the Franchisee authorize the Franchisee's payment processor to release the Information exclusively to the Franchisor and/or its designees.

What This Means (2024 FDD)

According to Aplus's 2024 Franchise Disclosure Document, following the termination or expiration of the Franchise Agreement, the franchisee is generally prohibited from using any of the information obtained during the term of the agreement. The exception to this is that the franchisee can use the information to comply with their post-term obligations as outlined in the agreement. The franchisee also authorizes their payment processor to release the information exclusively to Aplus and/or its designees.

This means that after the franchise agreement ends, the franchisee cannot leverage any customer data or other information gathered during their time as an Aplus franchisee for their own purposes, except when necessary to fulfill any remaining duties they have under the terminated agreement. This restriction is in place to protect Aplus's proprietary information and customer relationships.
