According to Aplus's 2024 Franchise Disclosure Document, Exhibit K is the receipt. The receipt includes the date of issuance, which in the example provided is April 26, 2024. The receipt also includes the name, principal business address, and telephone number of the franchise seller offering the franchise.
Prospective Aplus franchisees should note that the FDD summarizes provisions of the franchise agreement and other information. Aplus must provide the disclosure document to you 14 calendar days before you sign a binding agreement with, or make a payment to, the franchisor or an affiliate in connection with the proposed franchise sale.
Certain states have different requirements. For example, Michigan requires that Aplus give you the disclosure document at least ten business days before the execution of any binding franchise or other agreement or the payment of any consideration, whichever occurs first. New York requires Aplus to provide you the disclosure document by the earliest of (1) the first personal meeting to discuss the Aplus franchise; or (2) ten business days before the signing of a binding agreement; or (3) ten business days before a payment to Sunoco Retail LLC or its agent. If Aplus does not deliver the disclosure document on time or if it contains a false or misleading statement, or a material omission, a violation of federal law and State law may have occurred and should be reported to the Federal Trade Commission, Washington, D.C. 20580 and the state agency listed on Exhibit D. Aplus's agents for service of process are listed in Exhibit E.
