How far in advance of a proposed transfer of agreement or controlling interest must I submit a written request to Aplus?

Franchisor will not unreasonably withhold its consent to a transfer, but may condition its consent on satisfaction of any or all of the following:
- 8.4.1.
Your written request for consent and delivery of a copy of the proposed transfer agreements, including sale terms, at least 30 days prior to the proposed transfer, and Franchisor has determined, in its sole and reasonable discretion, that the terms of the sale will not materially and adversely affect the post transfer viability of any Store in operation at the time of transfer.

What This Means (2024 FDD)
According to Aplus's 2024 Franchise Disclosure Document, if you plan to transfer your agreement or a controlling interest in your Aplus franchise, you must submit a written request to Aplus at least 30 days before the proposed transfer. This request should include a copy of the proposed transfer agreements, detailing the terms of the sale.
Aplus will then assess whether the terms of the sale could negatively impact the viability of any existing Aplus store. This evaluation is at Aplus's discretion.
This 30-day notice allows Aplus to properly evaluate the proposed transfer, assess the transferee's qualifications, and ensure that all necessary conditions are met to protect the Aplus brand and the interests of other franchisees. Failing to provide this notice or obtain Aplus's consent can result in the transfer being deemed void and a material breach of the franchise agreement.
