What This Means (2024 FDD)
According to Aplus's 2024 Franchise Disclosure Document, the franchisee has significant autonomy over labor and employment matters. Specifically, the franchisee is responsible for all aspects of personnel management. Aplus franchisees are responsible for hiring, disciplining, training, discharging, compensating, providing benefits, managing, controlling, setting work rules, and handling payroll, including tax withholdings, for all personnel employed in their Aplus business.
This indicates that Aplus does not exert direct control over the franchisee's employees. The franchisee operates as an independent contractor and is expected to manage their staff independently. This arrangement is typical in many franchise systems, where franchisees are granted operational independence while adhering to the franchisor's brand standards and operational guidelines.
However, franchisees must ensure their employment practices comply with all applicable federal, state, and local laws. Failure to comply with these regulations constitutes a material breach of the Franchise Agreement, potentially leading to termination. While Aplus does not directly control employment matters, franchisees must operate within a legal framework, and Aplus retains the right to terminate the agreement if franchisees violate those laws.
