3. FEES
- 3.1. Development Fee. Upon execution of this Agreement, you shall pay to Franchisor a Development Fee in the amount set forth in the Summary Page ("Development Fee"). The Development Fee is fully earned by Franchisor when paid and is not refundable, in whole or in part, under any circumstances.
- 3.2. Initial Franchise Fee. For each Franchise Agreement signed under this Agreement, you shall pay to Franchisor an initial franchise fee deposit in the amount set forth in the Summary Page. When you sign a Franchise Agreement for the first Store contemplated under this Agreement, Franchisor will credit a portion of your Development Fee payment to fully satisfy the initial franchise due thereunder.

What This Means (2024 FDD)
According to Aplus's 2024 Franchise Disclosure Document, the Development Fee is not refundable under any circumstances. The FDD states that upon execution of the Development Agreement, the franchisee must pay Aplus a Development Fee, the amount of which is set forth in the Summary Page. Aplus earns this fee in full when it is paid. However, when a franchisee signs a Franchise Agreement for the first store, Aplus will credit a portion of the Development Fee to fully satisfy the initial franchise fee due. For each additional store, Aplus will credit a portion of the Development Fee to satisfy half of the initial franchise fee, with the franchisee paying the remaining balance.
