What This Means (2025 FDD)
According to Angry Chickz's 2025 Franchise Disclosure Document, franchisees typically have an opportunity to cure a default, with some exceptions. Specifically, if a franchisee defaults on the franchise agreement (excluding defaults under Sections 14.2 or 14.3), they have 30 days after receiving written notice from Angry Chickz to remedy the default and provide evidence of the remedy. However, if the default involves the timely payment of sums due to Angry Chickz or its affiliates, the cure period is reduced to just 5 days.
If the franchisee fails to cure the default within the applicable time frame (30 days or 5 days for payment defaults), the franchise agreement and all associated rights automatically terminate without further notice or opportunity to cure, unless Applicable Law requires a longer cure period or Angry Chickz specifies a longer period in the default notice. It is important to note that any description of a default in a notice from Angry Chickz does not prevent them from specifying additional or supplemental defaults in any legal action related to the agreement or its termination.
In the event of a default by the franchisee, Angry Chickz may choose to cure the default on behalf of the franchisee. The costs incurred by Angry Chickz in curing the default are due and payable on demand and are considered additional compensation due to Angry Chickz. This amount will be added to the next accruing compensation payment, as determined by Angry Chickz. This provision allows Angry Chickz to take immediate action to correct a franchisee's default while ensuring they are compensated for their expenses.
