Franchisee shall ensure that the operation of the Franchised Business is at all times under the control and supervision of the Operating Principal or Restaurant Leader. Franchisee shall supervise, direct and be responsible for in all respects, the activities and performance of the Operating Principal, Restaurant Leader and employees of Franchisee and shall ensure compliance with the Standards and this Agreement. Franchisee will obtain and maintain from each of its employees a written statement that each such person is an employee of Franchisee and not an employee of Company or any Affiliate of Company. With Company's consent, Franchisee's Restaurant Leader may be the same person as Franchisee's Operating Principal. Franchisee's Restaurant Leader must attend and successfully complete, to Company's satisfaction, the Initial Training Program.
