What This Means (2025 FDD)
According to the 2025 Angry Chickz Franchise Disclosure Document, the rights granted to the franchisee are nonexclusive. Angry Chickz retains all other rights, allowing it to operate or franchise others to operate restaurants outside the franchisee's protected area. This includes businesses providing similar goods and services either within or outside the protected area, with exceptions for restaurants in non-traditional venues.
This non-exclusivity means that Angry Chickz can establish other outlets, including company-owned or franchised locations, that may compete with a franchisee's business, provided they are outside the franchisee's protected territory. The protected area aims to provide some level of market exclusivity, but Angry Chickz maintains broad rights to expand its brand through various channels and locations.
For a prospective Angry Chickz franchisee, this implies a need to carefully evaluate the defined protected area and understand the potential for competition from other Angry Chickz outlets or related businesses. Franchisees should consider the demographics, traffic patterns, and overall market potential within their protected area to assess the viability of their investment, given the non-exclusive nature of the franchise rights. It is important to note that the franchisor has the right to develop other businesses that provide goods and services within or outside of the Protected Area.
This arrangement is relatively common in the franchise industry, where franchisors often balance the need to expand their brand footprint with the desire to provide franchisees with a reasonable degree of market protection. However, the specific terms of exclusivity, including the size and nature of the protected area, can vary significantly between franchise systems. Therefore, prospective franchisees should carefully review and negotiate these terms to ensure they align with their business goals and risk tolerance.
