What This Means (2025 FDD)
According to the 2025 Angry Chickz Franchise Disclosure Document, Angry Chickz has the discretion to revoke a waiver previously granted to a Developer. The FDD states that any waiver granted by Angry Chickz is subject to continuing review and may be revoked at any time and for any reason, at Angry Chickz's discretion. This applies to obligations imposed by the Area Development Agreement.
This means that even if Angry Chickz has previously waived a specific requirement or obligation for a developer, they retain the right to reinstate that requirement later. This could impact a developer's plans and potentially increase their costs if a previously waived obligation is suddenly enforced.
Prospective Angry Chickz developers should carefully consider this provision and understand that any waivers they receive are not guaranteed to be permanent. It would be prudent to discuss the circumstances under which a waiver might be revoked and to factor this risk into their business planning. This clause protects Angry Chickz and allows them flexibility in managing their franchise system, but it places the burden of uncertainty on the developer.
