During the Term, Developer may develop and thereafter construct, equip, open and operate pursuant to individual Franchise Agreements more than the total number of Dine-In Restaurants comprising the total Development Obligation (each an "Excess Restaurant") with Company's prior written consent, which consent may be conditioned on among other things, the payment of additional fees (except as provided below) and/or the execution of an amendment to this Agreement.

What This Means (2025 FDD)
According to the 2025 Angry Chickz Franchise Disclosure Document, an Angry Chickz developer may want to develop more restaurants than their initial development obligation. To do so, the developer must first obtain prior written consent from Angry Chickz.
Angry Chickz's consent to allow the developer to open more restaurants is conditional. Angry Chickz may require the developer to pay additional fees to develop the extra restaurants. The franchisor may also require the developer to execute an amendment to the existing Area Development Agreement.
These additional restaurants are referred to as "Excess Restaurants" in the agreement. This clause protects Angry Chickz and ensures they maintain control over the brand's expansion and can benefit financially from a developer's desire to grow beyond their initial commitment.
