8.5 Promotional Campaigns; Community Dine for A Cause.

  • 8.5.1 From time to time during the Term, Company shall have the right to establish and conduct promotional campaigns on a national or regional basis, which may by way of illustration and not limitation promote particular products or marketing themes. Franchisee agrees to participate in such promotional campaigns upon such terms and conditions as Company may establish. Franchisee acknowledges and agrees that such participation may require Franchisee to purchase point of sale advertising material, posters, flyers, product displays and other promotional material.
  • 8.5.2 At such time as Company implements a program intended to support various nonprofit organizations or charities through one or more events or programs, Franchisee shall actively participate in the program in accordance with the Manuals(s) at the Franchised Business. Amounts contributed by Franchisee to the beneficiaries of such program shall not reduce Gross Sales or be considered a part of Franchisee's Local Advertising Expenditure, unless expressly permitted in the Manual(s) or otherwise in writing by Company.
