What This Means (2025 FDD)
According to Angry Chickz's 2025 Franchise Disclosure Document, a delay in the company's acceptance of a site does not automatically extend the Development Period, except in specific circumstances. The document states that only a Force Majeure event or the company's legal disability to deliver a Franchise Disclosure Document can extend the Development Period.
Specifically, if a developer is unable to meet their development obligations due to a Force Majeure event (an event outside of their control) or Angry Chickz's legal inability to deliver a Franchise Disclosure Document, the Development Period will be extended by the amount of time that the event persists. However, any other delay, including delays in Angry Chickz's site acceptance, will not extend the Development Period. This includes delays resulting from the developer's failure to meet the conditions outlined in Section 6.3 of the agreement.
This policy places the onus on the developer to proactively manage site selection and approval processes. It also means that developers need to be aware of what constitutes a Force Majeure event and the required notification procedures to claim an extension. The developer must notify Angry Chickz in writing within 5 days of the Force Majeure event, explicitly describing the event and its impact. Failure to provide timely notice or updates will result in a waiver of the right to claim the extension.
