What This Means (2025 FDD)
According to the 2025 Angry Chickz Franchise Disclosure Document, a Restricted Person's duplication or use of the Confidential Information in any endeavor or business other than the franchised Angry Chickz business constitutes an unfair method of competition. Restricted Persons include the franchisee, their owners, and their immediate family members. Confidential Information includes the Angry Chickz System, Standards, recipes, secret ingredients, procedures, concepts, methods, and techniques of developing and operating a Restaurant and producing Authorized Products.
In practical terms, this means that an Angry Chickz franchisee and other Restricted Persons are prohibited from using the brand's proprietary information, such as recipes or operational methods, in any other business venture. This restriction applies to any business, not just competing restaurants. For example, a franchisee cannot use Angry Chickz's marketing strategies in a completely unrelated retail business.
This clause protects Angry Chickz's investment in its unique system and prevents franchisees from leveraging the franchisor's confidential information for personal gain outside of the franchise agreement. It is a standard practice in franchising to protect trade secrets and maintain a competitive advantage. Franchisees should carefully review the definition of "Confidential Information" in their Franchise Agreement to fully understand the scope of this restriction.
