Angry_Chickz Franchise · 2025 FDDAnswer from 2025 FDD Document
No statement, questionnaire or acknowledgement signed or agreed to by a franchisee in connection with the commencement of the franchise relationship shall have the effect of (i) waiving any claims under any applicable state franchise law, including fraud in the inducement, or (ii) disclaiming reliance on any statement made by any franchisor, franchise seller, or other person acting on behalf of the franchisor. This provision supersedes any other term of any document executed in connection with the franchise.

What This Means (2025 FDD)
According to Angry Chickz's 2025 Franchise Disclosure Document, the franchise agreement includes provisions that protect franchisees from waiving claims based on statements not within the FDD, specifically concerning reliance on statements made by the franchisor or their representatives. This protection is highlighted in addenda for several states, including California, Illinois, Maryland, and North Dakota, as well as generally.
These provisions ensure that franchisees are not bound by statements or promises made outside of the official disclosure document and franchise agreement. This is particularly relevant in instances of alleged fraud in the inducement, where a franchisee claims they were misled into signing the agreement based on information not included in the FDD. The inclusion of these clauses is intended to prevent Angry Chickz from disclaiming responsibility for representations made during the franchise sales process.
For a prospective Angry Chickz franchisee, this means that any verbal promises, marketing materials, or other representations made by the franchisor or its agents that are not documented in the Franchise Disclosure Document or the franchise agreement itself may still be grounds for a claim against the franchisor. This strengthens the franchisee's position by allowing them to hold Angry Chickz accountable for all representations made during the sales process, not just those formally written into the agreement. This protection supersedes any other conflicting terms in any document executed in connection with the franchise, reinforcing its importance.
