What This Means (2025 FDD)

According to the 2025 Angry Chickz Franchise Disclosure Document, the Continuing Guaranty primarily benefits Angry Chickz Franchising LLC. Specifically, the guaranty inures to the benefit of Angry Chickz and its successors and assigns. This means that the franchisor is protected by the agreement, and that this protection extends to any entity that takes over the franchisor's rights or responsibilities.

The Continuing Guaranty ensures that Angry Chickz has recourse to collect payments and enforce obligations, even if the franchisee is a business entity. The guarantor is guaranteeing the franchisee's performance of its obligations under the Franchise Agreement. This is a common practice in franchising, as it provides the franchisor with an additional layer of security.

Furthermore, the document states that the obligations of the Guarantor are joint and several with each and every other person or entity that now or hereafter executes a guaranty of any of the obligations separate from this Continuing Guaranty. This means that if there are multiple guarantors, each guarantor is fully responsible for the entire debt or obligation. Angry Chickz can pursue any one or all of the guarantors for the full amount owed.
