What This Means (2025 FDD)
According to Anago's 2025 Franchise Disclosure Document, Anago has the discretion to vary standards for a Unit Franchisee. These standards refer to the methods, specifications, and procedures for operating and managing a Unit Franchise and Subfranchise Business as detailed in the Anago Manuals.
Anago may vary these standards if it deems it in the best interest of all parties involved, considering specific circumstances. These circumstances include the peculiarities of the site, population density, business potential, the population of the trade area, existing business practices, or any other condition that Anago considers important for the successful operation of a Unit Franchise.
However, the FDD specifies that a Unit Franchisee is not entitled to a similar variation as a matter of right. This means that Anago's decision to vary standards for one franchisee does not obligate them to do the same for another, even if their situations appear similar. This clause provides Anago with flexibility to adapt to diverse market conditions and individual franchisee needs while maintaining overall system standards.
This discretion allows Anago to respond to unique local challenges or opportunities, potentially benefiting both the franchisee and the overall Anago system. However, it also introduces an element of uncertainty for franchisees, as they cannot assume that deviations from standard practices granted to others will be extended to them.
