It is important for prospective franchisees to understand that their rights to use these trademarks are derived solely from the Subfranchise Rights Agreement. Any unauthorized use of the Proprietary Property, including the Proprietary Marks, constitutes a breach of the agreement and an infringement of Anago's and ACS's rights. Franchisees must also promptly notify Anago of any claims of infringement or challenges to their right to use the Proprietary Property.
