What This Means (2025 FDD)

According to Anago's 2025 Franchise Disclosure Document, if Anago establishes an advertising fund, a statement of operations of the fund will be prepared annually by an independent public accountant selected by Anago. Upon reasonable request, Anago will provide a copy of the annual statement of operations to franchisees.

This means that while Anago is not obligated to establish an advertising fund, if one is created, they will have an annual statement of operations prepared. Franchisees have the right to request and receive a copy of this statement, allowing them to review how the advertising funds are being managed and spent.

However, the FDD also states that the advertising fund is not required to be audited and that Anago does not owe any fiduciary obligation to Subfranchisors or Unit Franchisees for administering the Fund or any other reason. This implies that the statement of operations, while prepared by an independent accountant, may not be subject to the same level of scrutiny as an audited financial statement. Prospective franchisees should consider this when evaluating the financial oversight of the advertising fund.
