According to Anago's 2025 Franchise Disclosure Document, franchisees must exercise caution when using the Proprietary Property to ensure it is not jeopardized in any manner. Proprietary Property includes Anago's Proprietary Marks, Confidential Information, and copyrighted information that the franchisee is entitled to use under the Franchise Agreement. Proprietary Marks include the service mark and logo "Anago" and all other trademarks, service marks, trade names, logos, and commercial symbols authorized as part of the Anago system.
This requirement means that franchisees must be vigilant in protecting Anago's brand and intellectual property. They should avoid any actions that could damage the brand's reputation or dilute its value. This includes using the Proprietary Property only for the operation of the Anago Unit Franchise, using the Proprietary Marks as the sole service mark identifications, and displaying the Proprietary Marks prominently on all authorized materials.
Furthermore, franchisees are prohibited from using the Proprietary Property as security for any obligation or indebtedness. They must also comply with Anago's instructions in filing and maintaining any required fictitious, trade, or assumed business name registrations. Franchisees must sign all documents deemed necessary by Anago or its counsel to protect the Proprietary Property and Anago's interest in the property. In addition, franchisees cannot register or use any domain name or URL that contains the words "Anago Cleaning Systems" or any portion thereof, or the initials "ACS," or any Proprietary Marks, or other related or confusingly similar words or symbols, without Anago's prior written consent. They also cannot use any other trade name or marks at their Unit Franchise business, or in connection with their Unit Franchise business without express written consent. If operating from a business premises, signage must identify the premises only as "Anago" and conform to Anago's requirements, except where prohibited by local regulations or landlord rules. These restrictions ensure consistent branding and prevent unauthorized use of Anago's intellectual property.
