What This Means (2025 FDD)
According to Anago's 2025 Franchise Disclosure Document, franchisees must keep their Anago Subfranchise open for the minimum hours and days that Anago requires in its manuals or in writing. However, this requirement is subject to limitations imposed by local governmental regulations or the landlord's rules and regulations. This means that if a local ordinance restricts business operating hours, the franchisee must comply with the local regulations, even if they conflict with Anago's standard operating hour requirements. Similarly, if the property's landlord has rules about operating hours, those rules take precedence.
For a prospective Anago franchisee, this clause offers some protection and flexibility. It acknowledges that local laws and property rules can vary and may necessitate deviations from Anago's standard operating procedures. Franchisees are not expected to violate local laws or lease agreements to adhere strictly to Anago's general requirements. This flexibility can be particularly important in areas with strict zoning laws or noise ordinances that could affect operating hours.
This provision highlights the importance of researching local regulations and lease terms before establishing an Anago Subfranchise. Franchisees should understand any potential conflicts between Anago's requirements and local rules to avoid compliance issues. It is also advisable to communicate with Anago about any such conflicts to ensure alignment and to receive guidance on how to best manage the situation while still meeting Anago's brand standards and customer service expectations.
