Does Amorino have sole discretion in approving the location of my franchise?

Approval of the location is at our sole discretion. Amorino will approve or refuse to approve a proposed site within 30 days after the receipt of all information that Amorino may reasonably require in connection with its evaluation of your proposed location. (Franchise Agreement, Section 4.A) You must identify a location to serve as your franchised location for the Store by the date set forth in the franchise agreement or we have the right to terminate the franchise agreement.

What This Means (2025 FDD)
According to Amorino's 2025 Franchise Disclosure Document, the approval of the location for your Amorino store is at Amorino's sole discretion. However, before you open your store, Amorino will spend time and effort to inspect a site you propose to lease or purchase. When you sign the franchise agreement, you and Amorino will mutually agree upon a site selection area where you can propose a location.
Amorino will review the information you provide to evaluate the location, including demographic characteristics, traffic patterns, parking, the character of the neighborhood, information on other area businesses, and information on the lease terms or purchase price. Amorino agrees not to unreasonably delay its review and notice of approval or disapproval of the proposed site and lease terms. Amorino will approve or refuse to approve a proposed site within 30 days after receiving all required information.
You must identify a location for your franchised store by the date set forth in the franchise agreement, or Amorino has the right to terminate the franchise agreement. This means that while you have input in suggesting locations, Amorino ultimately decides whether or not a site is suitable for an Amorino franchise.
