What This Means (2025 FDD)
According to Amorino's 2025 Franchise Disclosure Document, if a franchisee wants to provide Amorino goods or services at special events within their protected area, such as fairs, sporting events, exhibitions, charity events, or concerts, they must first notify Amorino of the opportunity. If the franchisee desires to participate in such events, they must inform Amorino about the type and location of the event, the nature of their proposed participation, and any other information Amorino reasonably requests.
Amorino then has a reasonable amount of time to consider the franchisee's request. Amorino has the option to either grant or deny the franchisee's request to participate in the event. Alternatively, Amorino may choose to undertake the participation themselves, meaning the franchisor could decide to manage the event presence instead of allowing the franchisee to do so.
This clause gives Amorino significant control over how its brand is represented at special events. For a prospective franchisee, this means they cannot independently decide to participate in local events without prior approval from Amorino. This ensures brand consistency but may also limit a franchisee's ability to capitalize on local marketing opportunities if Amorino denies their request or decides to participate themselves.
