What This Means (2025 FDD)
According to Amorino's 2025 Franchise Disclosure Document, an Amorino franchisee is restricted from employing or attempting to employ any individual who is or has been employed by Amorino or its affiliates as a salaried managerial employee within the previous 30 days. This restriction also includes directly or indirectly inducing such a person to leave their employment.
This clause is designed to protect Amorino from franchisees poaching employees who have knowledge of the Amorino system. The 30-day restriction is relatively short compared to some franchise systems, which can have non-solicitation periods of up to a year or more.
As a prospective franchisee, it's important to understand this restriction, especially if you are considering hiring someone who recently worked for Amorino or one of its affiliates. Violating this clause could have legal and financial repercussions, as Amorino could take action to enforce the non-solicitation agreement.
