From whom must Amorino franchisees purchase promotional materials?

We do not currently produce advertising materials; however you must purchase from us or our approved supplier all promotional materials designated by us to promote the sale of new and featured products. (Franchise Agreement, Section 12.C) We may elect to utilize various local, regional, and/or national media campaigns in the future which may include radio, television, magazine, newspaper, and internet advertising campaigns.
- (a) You may develop your own advertising and marketing materials, at your own expense, subject to such requirements or recommendations that are set forth in our current operating manual and subject to our prior approval.
We will review samples of the proposed advertising and marketing materials that you submit and will use good faith efforts to accept or reject such materials within fifteen (15) days from the date we receive them. (Franchise Agreement, Section 12.A) Advertising and marketing materials shall not be used until they are approved, and we have the right to disapprove of materials that were previously approved. What This Means (2025 FDD)
According to Amorino's 2025 Franchise Disclosure Document, franchisees must purchase designated promotional materials from Amorino or its approved suppliers. While Amorino does not currently produce advertising materials, this policy ensures brand consistency and quality control across all franchise locations.
Amorino franchisees do have the option to develop their own advertising and marketing materials. However, these materials are subject to Amorino's prior approval, and the franchisor retains the right to disapprove previously approved materials. This approval process allows Amorino to maintain its brand image and ensure that all advertising aligns with its standards.
Amorino also lists the franchisee's store location, phone number, and opening hours on its website as part of its advertising efforts. While Amorino does not currently charge an advertising fee, it retains the right to implement one in the future, up to three percent of the franchisee's annual Gross Revenue. These funds would be used for advertising, marketing, and public relations initiatives, though Amorino does not provide franchisees with an audit or accounting of these expenditures.
