Is an Amorino franchisee required to purchase promotional materials from Amorino or its approved supplier?

We do not currently produce advertising materials; however you must purchase from us or our approved supplier all promotional materials designated by us to promote the sale of new and featured products. (Franchise Agreement, Section 12.C) We may elect to utilize various local, regional, and/or national media campaigns in the future which may include radio, television, magazine, newspaper, and internet advertising campaigns.
- (a) You may develop your own advertising and marketing materials, at your own expense, subject to such requirements or recommendations that are set forth in our current operating manual and subject to our prior approval.
We will review samples of the proposed advertising and marketing materials that you submit and will use good faith efforts to accept or reject such materials within fifteen (15) days from the date we receive them. (Franchise Agreement, Section 12.A) Advertising and marketing materials shall not be used until they are approved, and we have the right to disapprove of materials that were previously approved. What This Means (2025 FDD)
According to Amorino's 2025 Franchise Disclosure Document, franchisees are required to purchase promotional materials from Amorino or its approved suppliers. Specifically, franchisees must acquire all promotional materials designated by Amorino to promote the sale of new and featured products from Amorino or an approved supplier.
However, franchisees also have the option to develop their own advertising and marketing materials. These materials are subject to the requirements and recommendations outlined in Amorino's operating manual and require Amorino's prior approval. Amorino commits to reviewing submitted materials in good faith within fifteen days of receipt. It is important to note that even previously approved materials can be subsequently disapproved by Amorino.
This requirement ensures brand consistency and quality control across all Amorino franchise locations. While franchisees have some creative freedom in developing their own materials, the ultimate decision on what is acceptable rests with Amorino. This allows Amorino to maintain a unified brand image while still allowing for some local marketing efforts.
