What This Means (2025 FDD)
According to Amerispec Inspection Services's 2025 Franchise Disclosure Document, Amerispec Inspection Services can set other reasonable conditions for a franchise assignment. Specifically, before an assignment can be completed, the assignee must meet several conditions. The assignee must enter into a written agreement with Amerispec Inspection Services, using a form that is satisfactory to them, to assume or guarantee the franchisee's obligations. Any existing defaults on the part of the franchisee must be resolved. The assignee must also demonstrate that they meet the current standards for Amerispec Inspection Services franchisees.
In essence, Amerispec Inspection Services retains significant control over who can become a franchisee through assignment. These stipulations ensure that the new franchisee is qualified and committed to upholding the standards of the Amerispec Inspection Services brand. This protects the brand and the network of existing franchisees.
These conditions are fairly standard in franchising. Franchisors typically want to ensure that any new franchisee, whether original or an assignee, meets their criteria for financial stability, business acumen, and commitment to the brand. A prospective franchisee should carefully review the franchise agreement and discuss these assignment conditions with Amerispec Inspection Services to fully understand the requirements and potential challenges of transferring the franchise in the future.
