If we grant you the right to operate a Franchised Business, you will sign a Franchise Agreement which gives you the right to use (i) the business plans and methods to be used in connection with the operation of the Franchised Business, including standards, specifications, methods, procedures, techniques, management systems, approved inspection software, identification schemes, know-how, and information (the "System of Operations"), and (ii) our "Marks", which include the AmeriSpec® marks and commercial trade names, trademarks, service marks and other commercial symbols, including associated logos, that we authorize for use in the Franchised Business, which are subject to change from time to time.
What This Means (2025 FDD)
According to Amerispec Inspection Services' 2025 Franchise Disclosure Document, the "Marks" that franchisees are permitted to use include the AmeriSpec® marks and commercial trade names, trademarks, service marks, and other commercial symbols, including associated logos. These marks are authorized for use in the franchised business and are subject to change.
As an Amerispec Inspection Services franchisee, it is crucial to adhere to the franchisor's guidelines regarding the use of these marks. This ensures brand consistency and protects the integrity of the AmeriSpec Inspection Services brand. Franchisees must only use the commercial trade names, service marks, or other commercial symbols that meet the criteria established by the company.
Furthermore, franchisees cannot use the Names and Marks in combination with other unauthorized elements, except when identifying their specific franchise location. If the franchisee operates as a corporation, LLC, or partnership, they cannot incorporate any of the Names and Marks into their legal business name. The franchisee must also file for and maintain a "Certificate of Trade Name" in the relevant jurisdiction. Amerispec Inspection Services retains the right to discontinue or introduce new Names and Marks, and while franchisees are responsible for the expenses associated with these changes, the company will compensate for certain obsolete materials under specific conditions.
