What This Means (2025 FDD)
According to the 2025 Amerispec Inspection Services FDD, franchisees must operate their business in a way that maintains and enhances the goodwill associated with the Amerispec Inspection Services brand's names and marks. This includes maintaining high-quality service to customers using their best efforts, skill, and diligence. The franchisee is responsible for the day-to-day management of the franchised business. Franchisees must also comply with all rules, regulations, and directives outlined in the franchise agreement and confidential AmeriSpec manuals, including merchandising, promotion, and advertising policies set by Amerispec Inspection Services, which the company can modify.
To maintain brand integrity, Amerispec Inspection Services franchisees must document all inspections on company-prescribed forms, notify the company of each inspection and revenue source, and ensure all inspections are conducted by qualified inspectors meeting company or legal standards. Franchisees must adhere to the types of structures they are authorized to inspect, typically single-family residences, multi-family dwellings for up to four families, and commercial buildings, unless they receive prior written consent from Amerispec Inspection Services to inspect other structure types. The franchisee must use their business office exclusively for selling goods and services associated with the Amerispec Inspection Services brand and authorized by the company.
Amerispec Inspection Services franchisees are also expected to keep their manuals up to date with any additions or modifications received from the company. They (or an approved representative) are required to attend company conventions or seminars, paying the convention fee regardless of attendance. Franchisees must participate in additional programs and services provided by Amerispec Inspection Services, following the company's established procedures. Franchisees must also take all actions reasonably necessary to maintain the integrity of the Names and Marks and preserve and protect the goodwill associated with the Names and Marks, including operating the Franchised Business in accordance with the standards and requirements of quality, appearance, cleanliness, and service that are associated with premium quality home inspection businesses.
Prior to distributing promotional materials, franchisees must provide Amerispec Inspection Services with copies or depictions of signs, brochures, advertisements, and other promotional materials. Franchisees are prohibited from using the brand's names and marks in any lewd, scandalous, obscene, libelous, or defamatory manner. Upon termination or expiration of the franchise agreement, franchisees must discontinue using the names and marks and remove all signs identifying the business as an AmeriSpec Inspection Services business. Franchisees must also relinquish all goodwill associated with the franchise to Amerispec Inspection Services.
