What This Means (2025 FDD)
According to the 2025 Amerispec Inspection Services FDD, franchisees are explicitly prohibited from using their email accounts to transmit libelous material. The agreement states that franchisees must use the email account only for lawful purposes. This includes not transmitting any material that is unlawful, harmful, abusive, hateful, obscene, threatening, libelous, or defamatory. This restriction is in place to protect the brand's reputation and ensure franchisees comply with all applicable laws and regulations.
Amerispec Inspection Services provides franchisees with access to email accounts to facilitate communication between franchisees, third parties, and the company itself. The company retains ownership of the email account and address, emphasizing that the franchisee's use of the account is subject to the franchisor's guidelines and restrictions. Franchisees are responsible for any costs incurred in using or obtaining access to the email account.
The FDD also states that Amerispec Inspection Services may apply anti-spam and anti-virus solutions to the email accounts, further ensuring compliance and security. While the company aims to use the most efficient solutions, it does not guarantee their effectiveness and is not liable for any loss or damages resulting from viruses or the deployment of these solutions. Franchisees must adhere to these guidelines to maintain their franchise agreement and avoid potential termination.
In addition to restrictions on email content, the FDD also specifies that franchisees must not use the Amerispec Inspection Services' Names and Marks in any lewd, scandalous, obscene, libelous, or defamatory manner. This extends the protection of the brand's reputation beyond just email communications, covering all aspects of the franchisee's business operations and marketing efforts.
