What This Means (2025 FDD)
According to Amerispec Inspection Services's 2025 Franchise Disclosure Document, if a franchisee purchases a franchise in Washington and becomes involved in arbitration or mediation, the proceedings will occur in Washington. However, the location can change if all parties agree to a different site at the time of the arbitration or mediation. The arbitrator or mediator can also determine an alternative location during the proceedings.
Additionally, the FDD states that if litigation is not precluded by the Franchise Agreement, a franchisee can initiate legal action or proceedings in Washington if it arises from the sale of franchises or a violation of the Washington Franchise Investment Protection Act.
In cases where there is a conflict of laws, the provisions of the Washington Franchise Investment Protection Act, Chapter 19.100 RCW, will take precedence.
