What This Means (2025 FDD)

According to the 2025 Amerispec Inspection Services FDD, Item 23 discusses staffing. Specifically, it states that Amerispec Inspection Services does not control, nor have the right to control, decisions regarding the persons a franchisee hires, disciplines, or terminates as employees or agents. However, Amerispec Inspection Services may take legal action necessary to enforce its rights under the Franchise Agreement.

The FDD also states that Amerispec Inspection Services requires that franchisees perform background checks and drug testing as allowed by law. These policies do not constitute Amerispec Inspection Services' representation of approval or disapproval of any prospective employees. The franchisee remains solely responsible for decisions regarding hiring and maintaining employees, including determining whether the prospective employee meets the franchisee's hiring and performance standards or is suitable for the employment position.

This means that while Amerispec Inspection Services sets some minimum requirements (background checks, drug testing), the franchisee has significant autonomy in hiring and managing their own staff. However, franchisees must be aware of and comply with all applicable employment laws. Franchisees should confirm with the franchisor what the required background checks and drug testing entail.
