What This Means (2025 FDD)
According to the 2025 Amerispec Inspection Services FDD, the company does not control, nor does it have the right to control, decisions regarding the persons Franchisee hires, disciplines, or terminates as employees or agents. However, Amerispec Inspection Services may take any legal action necessary to enforce its rights under the Franchise Agreement.
Amerispec Inspection Services requires that Franchisees perform background checks and drug testing as allowed by law. These policies will not constitute the Company's representation of approval or disapproval of any prospective employees. Franchisees will remain solely responsible for decisions regarding hiring and maintaining Franchisee's employees, including determinations of whether the prospective employee meets Franchisee's hiring and performance standards or is suitable for the employment position.
This means that while Amerispec Inspection Services mandates background checks and drug testing, the responsibility for hiring decisions and employee suitability rests entirely with the franchisee. The franchisor's requirement for background checks and drug testing is a risk-management measure, but franchisees must still develop their own hiring and performance standards.
