Amerispec_Inspection_Services Franchise · 2025 FDD

Answer from 2025 FDD Document

The Company does not control, and does not have the right to control, decisions regarding the persons Franchisee hires, disciplines, or terminates as employees or agents.

However, the Company may take any legal action necessary to enforce its rights under this Agreement.

The Company also requires that Franchisee perform background checks and drug testing as allowed by law.

These policies will not constitute the Company's representation of approval or disapproval of any prospective employees.

In all cases Franchisee will remain solely responsible for decisions regarding hiring and maintaining Franchisee's employees, including determinations of whether the prospective employee meets Franchisee's hiring and performance standards or is suitable for the employment position.

What This Means (2025 FDD)

According to Amerispec Inspection Services's 2025 Franchise Disclosure Document, Item 23, section 9.3, covers the topic of background checks and drug testing for potential employees. While Amerispec Inspection Services does not control hiring decisions, they do require franchisees to perform background checks and drug testing on job applicants, as permitted by law.

This requirement ensures that franchisees take appropriate measures in their hiring process. However, the FDD clarifies that these policies do not represent approval or disapproval from Amerispec Inspection Services regarding prospective employees. The franchisee retains sole responsibility for hiring decisions, including determining if an applicant meets their standards and is suitable for the position.

For a prospective Amerispec Inspection Services franchisee, this means they must implement procedures for conducting background checks and drug testing in compliance with applicable laws. They must also understand that the final decision on hiring and maintaining employees rests solely with them, and they are responsible for ensuring their employees meet the required standards.
