What This Means (2025 FDD)

According to the 2025 Amerispec Inspection Services FDD, Amerispec Inspection Services retains exclusive control over any litigation or administrative proceedings related to infringement, challenges, or claims concerning its Names and Marks. This means that if a third party infringes on the Amerispec Inspection Services trademarks, the company, not the franchisee, decides whether to pursue legal action.

As an Amerispec Inspection Services franchisee, you are required to immediately notify the company of any potential infringement or challenges to the use of their Names and Marks. You are also prohibited from communicating with any other party regarding such infringement, challenge, or claim without the company's consent. This ensures that Amerispec Inspection Services maintains a unified and strategic approach to protecting its brand.

This arrangement benefits the franchisee by relieving them of the financial and legal burden of pursuing infringement claims. However, it also means that the franchisee has no direct control over whether or not action is taken to protect the brand in their specific market. A prospective franchisee should consider the implications of relinquishing control over trademark enforcement and discuss any concerns with existing franchisees or the franchisor before investing.
