Answer from 2025 FDD Document

In any arbitration or mediation involving a franchise purchased in Washington, the arbitration or mediation site will be either in the state of Washington, or in a place mutually agreed upon at the time of the arbitration or mediation, or as determined by the arbitrator or mediator at the time of arbitration or mediation.

In addition, if litigation is not precluded by the Franchise Agreement, a franchisee may bring an action or proceeding arising out of or in connection with the sale of franchises, or a violation of the Washington Franchise Investment Protection Act, in Washington.

What This Means (2025 FDD)

According to the 2025 Amerispec Inspection Services Franchise Disclosure Document, for franchises purchased in Washington, the location for any arbitration or mediation will be in the state of Washington. However, there are a couple of exceptions to this rule.

First, the location can be a place that is mutually agreed upon by all parties involved at the time the arbitration or mediation is set to occur. This allows for flexibility if both Amerispec Inspection Services and the franchisee find a more convenient or suitable location.

Second, the arbitrator or mediator has the authority to determine the location at the time of the arbitration or mediation. This provides a mechanism to decide on a location if the parties cannot agree, ensuring the process can move forward. The FDD also notes that a franchisee may bring an action or proceeding arising out of or in connection with the sale of franchises, or a violation of the Washington Franchise Investment Protection Act, in Washington, if litigation is not precluded by the Franchise Agreement.
