Item 13: Trademarks
If we grant you a Franchised Business, we will grant you the right to operate such Franchised Business under the Marks that we specify in your Franchise Agreement or otherwise in writing from time to time. We may add to, change, or remove Marks from time to time.
In the Acquisition, we acquired the Marks from Immediate Predecessor. Immediate Predecessor registered the Marks listed below on the Principal Register of the United States Patent and Trademark Office (the "USPTO") and filed all necessary affidavits and renewals for such Marks.

What This Means (2025 FDD)
According to Amerispec Inspection Services's 2025 Franchise Disclosure Document, the company retains the right to modify its trademarks. Specifically, Amerispec Inspection Services may add to, change, or remove Marks from time to time. This means that the specific logos, slogans, and other branding elements that a franchisee uses could be altered during the term of their agreement.
If Amerispec Inspection Services adopts new Marks or changes existing ones, franchisees are obligated to use the new or modified Marks and discontinue using any Marks that Amerispec Inspection Services decides to change or discontinue. However, Amerispec Inspection Services will provide sufficient notice to allow franchisees to use any trademarked stationery and marketing materials bought in the last 90 days that will become obsolete. Alternatively, at their option, Amerispec Inspection Services will purchase those materials from the franchisee at their cost.
This policy is fairly standard in franchising, as franchisors need the flexibility to update their branding to stay current and competitive. However, it's important for prospective Amerispec Inspection Services franchisees to understand that they may be required to invest in new marketing materials if the Marks are changed. The franchisor's commitment to either provide sufficient notice or repurchase obsolete materials at cost does offer some financial protection to the franchisee.
