You will notify us in writing upon your completion of the Construction Work.

We will have the sole right to determine whether the Construction Work has been completed in accordance with the Franchise Agreement and the Brand Standards.

In addition to compliance with and completion of all pre-opening obligations in the Franchise Agreement, you will not open your Hotel under the Marks until we confirm in writing that the Construction Work has been completed to our satisfaction in our sole discretion.

What This Means (2025 FDD)

According to Americas Best Value Inn's 2025 Franchise Disclosure Document, upon completion of construction work, the franchisee must notify the franchisor in writing. Americas Best Value Inn has the sole right to determine if the construction work aligns with the franchise agreement and brand standards. The franchisee cannot open the hotel under the Americas Best Value Inn brand until written confirmation is received from the franchisor stating the construction work is completed to their satisfaction.

Americas Best Value Inn may participate in progress meetings and inspect the hotel during construction but is not obligated to do so. Their participation and inspection do not represent an endorsement of the construction's adequacy, structural integrity, or the sufficiency of mechanical and electrical systems. If required by Americas Best Value Inn, the franchisee's architect, general contractor, or another certified professional must provide a certificate stating that the as-built premises comply with the Americans with Disabilities Act and all state and local codes for accessible facilities.

The franchisee is responsible for securing all necessary licenses, permits, and zoning variances for the construction work and must submit copies of these documents to Americas Best Value Inn for approval before starting construction. The franchisee must also ensure the hotel and construction work comply with all applicable laws, bylaws, statutes, ordinances, orders, rules, regulations, permits, licenses, authorizations, directions, and requirements of all governmental authorities, including environmental, zoning, building, and life safety codes.

If the franchisee fails to complete the construction work by the specified Construction Work Completion Date, it is considered a default under Section 13 of the Franchise Agreement. Furthermore, the franchisee cannot open the hotel until they receive written authorization from Americas Best Value Inn, which will only be granted once the franchisor is satisfied that all terms and conditions of the Franchise Agreement have been met.
