If you become aware of a suspected or actual breach of security or unauthorized access involving Personal Information, you will notify us immediately and specify the extent to which Personal Information was compromised or disclosed. You also agree to follow our instructions regarding curative actions and public statements relating to the breach. We reserve the right to conduct a data security and privacy audit of your Hotel and your point of sale and computer hardware and software systems at any time, from time to time, to ensure that you are complying with our requirements. You must promptly notify us if you receive any complaint, notice, or communication, whether from a governmental agency, customer, or other person, relating to any Personal Information, or your compliance with your obligations relating to Personal Information under this Agreement, and/or if you have any reason to believe you will not be able to satisfy any of your obligations relating to Personal Information under this Agreement.

According to the 2025 Americas Best Value Inn Franchise Disclosure Document, if a franchisee becomes aware of a suspected or actual breach of security or unauthorized access involving Personal Information, they must immediately notify Americas Best Value Inn and specify the extent to which Personal Information was compromised or disclosed.

The franchisee also agrees to follow Americas Best Value Inn's instructions regarding curative actions and public statements relating to the breach. Americas Best Value Inn retains the right to conduct data security and privacy audits of the franchisee's hotel, point of sale, and computer systems to ensure compliance with their requirements.

Furthermore, the franchisee must promptly notify Americas Best Value Inn if they receive any complaint, notice, or communication from a governmental agency, customer, or other person relating to any Personal Information, or their compliance with obligations relating to Personal Information under the Franchise Agreement. This includes any reason to believe they will not be able to satisfy their obligations relating to Personal Information under the agreement.
