What This Means (2025 FDD)
According to Americas Best Value Inn's 2025 Franchise Disclosure Document, opening your hotel before receiving written authorization from the franchisor constitutes unauthorized use of the brand's Marks. This action is also considered a material breach of the Franchise Agreement.
For a prospective Americas Best Value Inn franchisee, this means that you must not open your hotel to the public until Sonesta RL Hotels Franchising Inc. has given you explicit written permission. This authorization will only be granted once the franchisor is satisfied that you have met all the terms and conditions outlined in the Franchise Agreement and its associated riders, including Section 8.(b).
Opening prematurely can lead to significant financial repercussions, as you would be liable for damages as specified in Section 8.(b) of the Franchise Agreement. Therefore, it is crucial to adhere strictly to the pre-opening requirements and obtain written authorization before commencing operations to avoid legal and financial penalties and to remain in compliance with the franchise agreement.
