What This Means (2025 FDD)

According to Alloy's 2025 Franchise Disclosure Document, there are no contractual limitations on the franchisor's access to a franchisee's data. Alloy maintains independent access to data stored through the franchisee's CRM account. This access allows Alloy to download information related to the franchised business, including the client database and sales information, through the CRM software. Alloy may also have separate independent access to the franchisee's computer system at its discretion.

Because Alloy owns the relationship with the CRM software and provides access to it, the customer database is considered Alloy's property. A franchisee is prohibited from retaining a copy of the customer database after the Franchise Agreement expires or is terminated. This stipulation ensures that Alloy retains control over customer data and relationships developed during the franchise term.

Furthermore, Alloy can require franchisees to update or upgrade their computer systems without any contractual limitations on the franchisor's right to request these updates or on the costs associated with them. This allows Alloy to ensure that all franchise locations operate on compatible and up-to-date systems, which may be beneficial for maintaining brand consistency and data security. However, franchisees should be aware that they will bear the costs of these updates and upgrades, which can range from $600 to $1,200 annually for maintenance, updating, upgrading, or support contracts for the computer system.
