What This Means (2025 FDD)
According to the 2025 Alloy FDD, the term of the Area Development Agreement, including all rights granted to the franchisee, will expire on the date that the last Alloy Facility is scheduled to be opened under the Development Schedule. This is subject to the terms detailed in Section 2.C and unless sooner terminated in accordance with Section 7 of the agreement.
This means that the length of the agreement is tied directly to the franchisee's development schedule. The agreement lasts until the date the final facility is scheduled to open. This structure incentivizes franchisees to adhere to the agreed-upon development timeline, as their rights under the Area Development Agreement are contingent upon meeting the schedule.
Prospective franchisees should carefully review the Development Schedule outlined in their agreement to fully understand the term and their obligations. They should also be aware of the conditions under which the agreement can be terminated early, as detailed in Section 7, to avoid any unexpected loss of rights.
