What This Means (2025 FDD)
According to Alloy's 2025 Franchise Disclosure Document, if a franchisee submits advertising and promotional materials to Alloy for approval, and Alloy does not respond within 14 days, the advertising materials will be considered not approved. This means that franchisees must receive explicit approval from Alloy before using any advertising or promotional materials.
This requirement ensures that all marketing efforts align with Alloy's brand standards and trademark guidelines. Alloy retains control over the marketing message and presentation to maintain consistency across all franchise locations. Franchisees cannot assume that their materials are acceptable simply because they haven't received a rejection within the specified timeframe.
Alloy does state that it will not unreasonably withhold approval of any sales promotion materials or media and activities, provided that they are current, in good condition, in good taste and accurately depict the Trademarks. This suggests that Alloy aims to be cooperative in approving franchisee-initiated marketing efforts, as long as they meet certain quality and brand-related criteria. Franchisees should factor in this approval timeline when planning their marketing campaigns to avoid delays.
