Does Alloy guarantee the success of a new facility if the developer meets the then-current standards?

Alloy Franchise · 2025 FDD

Answer from 2025 FDD Document

You must receive written confirmation from us that you meet our then-current standards for franchisees, including financial capability criteria for the development of a new Facility.

You acknowledge and agree that this requirement is necessary to ensure the proper development and operation of your Facilities, and to preserve and enhance the reputation and goodwill of all ALLOY facilities and the goodwill of the Trademarks.

Our confirmation that you meet our then-current standards for the development of a new Facility, however, does not in any way constitute a guaranty by us as to your success.

What This Means (2025 FDD)

According to Alloy's 2025 Franchise Disclosure Document, Alloy does not guarantee the success of a new facility, even if the franchisee meets the then-current standards for development. The FDD states that receiving confirmation from Alloy that a franchisee meets the current standards for developing a new facility does not constitute a guarantee of success.

This means that while Alloy sets standards and evaluates franchisees to ensure they meet certain criteria, fulfilling these requirements does not ensure profitability or business viability. Prospective franchisees should not interpret Alloy's approval as a promise of financial success.

This disclaimer is a common practice in franchising. The success of an Alloy franchise depends on various factors, including the franchisee's management skills, local market conditions, and the ability to execute the Alloy business model effectively. Franchisees bear the ultimate responsibility for the success of their individual Alloy businesses.

Therefore, potential Alloy franchisees should conduct thorough market research, develop a comprehensive business plan, and carefully assess their own capabilities and resources before investing in a franchise. They should not rely solely on Alloy's approval as an indicator of potential success.
