What This Means (2025 FDD)
According to Alloy's 2025 Franchise Disclosure Document, Alloy may direct franchisees regarding trademark use through written directives. Specifically, franchisees may only use trademarks, trade names, or service marks in connection with the Alloy facility as outlined in the manual or as otherwise directed by Alloy in writing.
Alloy franchisees are permitted to use Alloy's trademarks on materials like business cards, stationery, and checks, provided they accurately depict the trademarks as prescribed by Alloy. Additionally, franchisees must include a statement indicating that the business is independently owned and operated. The franchisee cannot use Alloy's trademarks in conjunction with any other trademarks, trade names, or service marks unless Alloy provides explicit written approval beforehand. Alloy also requires that franchisees provide copies of any materials displaying the trademarks upon request.
Furthermore, Alloy requires franchisees to prominently display a sign at their facility identifying themselves as an Alloy franchisee. This sign must be in a format that Alloy deems reasonably acceptable, acknowledging that the facility is independently owned and operated and that the Alloy trademark is owned by Alloy and used under license. All internal and external signs must adhere to Alloy's outdoor/indoor guidelines and practices, which may be updated periodically.
These guidelines ensure that Alloy maintains control over its brand identity and that franchisees use the trademarks in a manner consistent with Alloy's standards. Franchisees must stay informed of any written directives from Alloy regarding trademark usage to avoid violating the franchise agreement.
