Does Alloy have to approve the site for each Facility I develop under the Area Development Agreement?

Alloy Franchise · 2025 FDD

Answer from 2025 FDD Document

We will approve the site for each Facility that you develop under the Area Development Agreement as set forth in the Franchise Agreement for each Facility. Below is a sample Minimum Performance Schedule for an Area Development Agreement for three Facilities.

For each Facility to be developed under an Area Development Agreement, we will have 30 days after receiving all information we require concerning the proposed site to notify you whether the site is accepted or not. If we do not provide our specific acceptance of a location within this 30 day period, the location is deemed not accepted. Our acceptance only indicates that the site meets our minimum criteria for a Facility. If you are unable to obtain possession of a suitable site for your Franchised Business by lease, sublease or purchase agreement within six months after you sign the Franchise Agreement, we may provide you with an extension of this timeframe or we may terminate your Franchise Agreement for that Facility.

What This Means (2025 FDD)

According to Alloy's 2025 Franchise Disclosure Document, Alloy must approve the site for each facility developed under the Area Development Agreement. Alloy has 30 days after receiving all required information about the proposed site to notify the franchisee whether the site is accepted. If Alloy does not provide specific acceptance within this 30-day period, the location is deemed not accepted. Alloy's acceptance indicates that the site meets their minimum criteria for a Facility.

If a franchisee is unable to obtain possession of a suitable site via lease, sublease, or purchase agreement within six months after signing the Franchise Agreement, Alloy may provide an extension or terminate the Franchise Agreement for that Facility. This highlights the importance of securing a suitable location promptly after signing the agreement.

This approval process is a standard practice in franchising, as it allows Alloy to maintain brand consistency and ensure that each location has the potential to succeed. Franchisees should work closely with Alloy to identify and secure a site that meets the franchisor's criteria to avoid delays or potential termination of the agreement.
