Death or Incapacity of FRANCHISEE.
FRANCHISEE, by will or other written instrument, may appoint a designated heir to continue operation of the Agency, upon FRANCHISEE's death.
Said designated heir must meet the qualifications of Section XVI.B.
No fee will be charged on a Transfer pursuant to this Section.
The Transfer of the FRANCHISEE's Interest in this Agreement and in the Agency to the FRANCHISEE's heirs, personal representatives or conservators, as applicable, in the event of death or legal incapacity of the FRANCHISEE, shall not give rise to ATFC's right of first refusal as set forth in Section XVI.E below, provided that the heirs, personal representatives or conservators, as applicable, meet ATFC's standards for new franchisees; execute the then-current form of Franchise Agreement; and, that a manager has, or within thirty days, shall have satisfactorily completed ATFC's Initial Training Program.

What This Means (2025 FDD)
According to All Team's 2025 Franchise Disclosure Document, a transfer of the franchise due to death does not incur a transfer fee. The FDD specifies that a franchisee can designate an heir in a will or other written instrument to continue operating the All Team agency upon their death. This designated heir must meet the standard qualifications for franchisees.
To complete the transfer, the heir, personal representative, or conservator must meet All Team's standards for new franchisees, execute the then-current form of the Franchise Agreement, and ensure a manager has completed All Team's Initial Training Program, or does so within 30 days.
This policy provides a benefit to the franchisee's family, allowing for a smoother transition of the business without the added financial burden of a transfer fee. It is important to note that while no transfer fee is charged, the heir or representative must still meet All Team's standards and fulfill certain requirements to ensure the continued successful operation of the franchise.
