Neither USER nor any individual whose compensation for services is paid by USER in any way, directly or indirectly, expressly or by implication, shall be construed to be an employee of ATFC for any purpose, including, without limitation any tax or withholding requirements levied or fixed by any governmental law, rule or regulation is solely responsible for the day-to-operations of the Business.

What This Means (2025 FDD)
According to All Team's 2025 Franchise Disclosure Document, the USER (franchisee) is solely responsible for the day-to-day operations of the Business. This means the franchisee has complete control and accountability for the daily management and functioning of their All Team franchise.
This responsibility extends to all aspects of running the temporary personnel service business. The franchisee makes the decisions and handles the tasks necessary to keep the business running smoothly. However, the USER cannot obligate All Team for any liabilities or expenses unless All Team agrees in writing. This reinforces the franchisee's independent contractor status and financial responsibility.
Furthermore, the FDD clarifies that neither the USER nor anyone paid by the USER is considered an employee of All Team. This distinction is important for tax and legal reasons, as the franchisee is responsible for all tax withholding and compliance related to their own employees. The franchisee also warrants that they operate their Business in compliance with all applicable local, state and federal laws, including without limitation the Fair Labor Standards Act and all applicable tax withholding laws and regulations.
