Who is responsible for selecting the mediator in an All Team franchise dispute?

According to All Team's 2025 Franchise Disclosure Document, in the event of a dispute requiring mediation, both All Team Franchise Corporation (ATFC) and the franchisee (USER) will jointly select the mediator. This collaborative approach aims to find a mutually agreeable and impartial individual to facilitate the mediation process.

However, if ATFC and the franchisee cannot come to an agreement on the mediator, the selection process defaults to the American Arbitration Association (AAA). In this case, the AAA will choose the mediator, using their established rules and guidelines to ensure a fair and unbiased selection. This provision ensures that the mediation process can proceed even if the parties are unable to agree on a mediator independently.

The cost of the Mediation, including the mediator's fee and expenses, shall be paid by the USER. The mediation will take place in Tampa, Florida unless both parties agree to a different location.
